International Trade Commission to Review ITC Judge's Initial Ruling in SiRF-Broadcom Case
SAN JOSE, Calif., Oct. 10 /PRNewswire-FirstCall/ -- SiRF Technology Holdings, Inc. , a leading provider of GPS-powered location platforms, today announced that the International Trade Commission (Commission) has issued a notice for review in part of the Initial Determination by the ITC Administrative Law Judge that certain SiRF products infringed upon six patents held by Global Locate, Inc., a wholly-owned subsidiary of Broadcom. Specifically the Commission has determined to review claims on three out of the six patents.
"We are pleased that the Commission has accepted our appeal to review the initial ruling of the Administrative Law Judge," said Kanwar Chadha, founder of SiRF Technology. "We are working closely with our customers to implement multiple measures to enable them to continue to ship their innovative products into the U.S. market."
In addition, the Commission has requested written submissions from the parties to address the form of remedy, if any, that should be ordered. According to the notice, if the Commission contemplates some form of remedy, it must consider the effects of that remedy upon public interest. The final Commission ruling, which is due to be issued in December 2008, is further subject to a sixty-day Presidential review period and can then be appealed to the Federal Circuit Court of Appeals.
During the last 13 years, SiRF has built a patent portfolio in the location technology field that includes more than 250 patents awarded worldwide and more than 370 additional patent applications pending. SiRF's patent portfolio also includes some of the early GPS patents that SiRF acquired through its acquisition of Conexant's GPS business in 2003, and Motorola's GPS assets in 2005.
